Unnao Rape Case: Supreme Court Halts Suspension of Kuldeep Sengar’s Life Sentence

In a significant development in the Unnao rape case, the Supreme Court on Monday put an immediate stay on the Delhi High Court’s order that had suspended the life sentence of expelled BJP leader and former MLA Kuldeep Singh Sengar. The apex court also issued a notice to Sengar while taking up the appeal filed by the Central Bureau of Investigation (CBI).

Earlier, on December 23, the Delhi High Court had suspended Sengar’s life imprisonment in the rape case, citing the fact that he had already spent more than seven years behind bars. The relief was granted pending the outcome of his appeal against the 2019 trial court verdict that convicted him in the case involving the rape of a minor.

Despite the suspension of sentence, Sengar was not released from jail as he is also serving a separate 10-year prison term in connection with the custodial death of the survivor’s father. He has not been granted bail in that case.

While suspending the sentence, the High Court had imposed strict conditions on Sengar, including furnishing a personal bond of ₹15 lakh along with three sureties of the same amount. The court had also barred him from entering within a five-kilometre radius of the survivor’s residence in Delhi and directed him not to intimidate or contact the survivor or her mother. Any violation of these conditions was to result in automatic cancellation of bail.

During the hearing on Monday, the Supreme Court stayed the High Court’s order and sought a response from Sengar on the CBI’s challenge. The apex court will now examine whether the relief granted by the High Court was legally justified.

The Unnao rape case dates back to 2017 and had triggered widespread public outrage across the country. Legal observers see the Supreme Court’s latest intervention as a crucial step toward ensuring justice for the survivor and upholding the rule of law.
